1. Who we are and what these Terms cover

These Terms are an agreement between you and Liontude, LLC. These Terms of Use (“Terms”) are a binding agreement between you and Liontude, LLC, a Florida limited liability company with its principal place of business at 1319 N University Dr #118, Coral Springs, FL 33071, United States (“Liontude”, “we”, “us”, “our”).

They cover the Sort Duel app and sortduel.com. You accept these Terms by installing or using the app. If you do not accept them, do not use the Service.

Two documents make up the agreement. These Terms, and the Sort Duel Privacy Policy at https://sortduel.com/privacy, which explains what data the Service collects and what we do with it. If the two conflict, the Privacy Policy controls on how we handle your data, and these Terms control on everything else.

Some sections override the rest. Within these Terms, section 19 (“Law and disputes”) and the consumer protections in section 16 (“Our liability”) control over any other section.

3. Who can use the Service

You must be at least 13. If the law where you live sets a higher minimum age for using a service like this one without a parent’s consent, you must be at least that age.

If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you. That person is responsible for your use of the Service.

You must be allowed to use the Service under the law that applies to you. You confirm that you are not located in a country subject to a U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.

4. Your account

The App creates an anonymous account for you. There is no email, password or social login. The Account is tied to the App on your phone.

Your progress is saved to the cloud. Your Account keeps your progress, scores, Coins, duel rating and duel record on our servers, and a copy on your phone.

You cannot move your Account to another phone. There is no way to transfer an Account, its progress or its Coins to a different phone or to another player.

You can delete your Account from Settings in the App. You confirm the deletion before it happens. Deletion cannot be undone: you lose your progress, your Coins and your Alias. What happens to your data when you delete your Account is explained in the Privacy Policy.

Deleting your Account does not remove Premium. Premium belongs to your Apple or Google account, so the App grants it again the next time it starts (section 10, “Premium”).

5. Your alias

Your Alias is public. Other players see it, with your avatar color, on leaderboards, in Duels and on your Recorded runs.

Aliases follow these rules. An Alias has 3 to 16 characters, using letters, numbers or underscores. It must be unique. You can change it once every 30 days.

Aliases are checked automatically. The App and our server reject aliases that match a list of offensive words. We do not review Aliases by hand.

Choose an Alias that is yours to use. Do not use an Alias that impersonates another person, uses someone else’s trademark, or is offensive in a way the automatic check misses.

You give us permission to show your Alias and your games. You grant Liontude a worldwide, royalty-free, non-exclusive permission to store, copy and show your Alias, your avatar color, your scores, and the moves and times of your games to other players, including as Recorded runs that others race against. This permission is only for running the Service. It ends when you delete your Account, except for copies that the Privacy Policy says we keep after deletion, and only for as long as it says.

6. Playing fair

Play the game as it is offered. You agree not to:

Scores count only when our server can replay them. Our server replays the moves behind every score before it counts: if the moves do not solve that board, the score does not count.

7. Scores, leaderboards and duels

Everyone plays the same 2,000 levels. The levels are the same boards in the same order for every player. After level 2,000, the App gives you random boards at the highest difficulty, and those do not count for the leaderboards.

Your total score never goes down. Your score for a level is based on your moves against the shortest solution and on your time. Your total is the sum of your best score on each level.

Leaderboards show the top 10. There are two leaderboards: TOP PLAYERS, by score, and TOP DUELISTS, by duel rating. Each shows the top 10 players and your own approximate position.

These are the rules of a Duel.

QUICK DUEL can match you with a Recorded run. QUICK DUEL looks for an online player within 10 levels of yours. If nobody turns up within 10 seconds, you race a Recorded run of a real player on the same board.

A friend can race your Recorded run. When you challenge a friend with a code and choose PLAY NOW, you play first, and your friend races your Recorded run later.

8. Online features

The levels play offline. Some features need the internet. The 2,000 levels are stored on your phone and play without a connection. Leaderboards, Duels, cloud saving and duel notifications need an internet connection.

Online features can change or end. We may change, suspend or end any online feature, including leaderboards, Duels, cloud saving and notifications. The 2,000 offline levels do not depend on them.

We do not promise the Service will always be available. The Service may be interrupted for maintenance, by outages at our providers, or by problems with your connection.

9. Coins

Coins have no money value. Coins are virtual items you earn by playing. They are not money, not property and not a deposit.

You cannot buy, sell or exchange Coins. Coins cannot be bought with money, sold, transferred to another player or exchanged for money or anything outside the App.

We set how Coins work, and we can change it. We decide how many Coins each action earns and how many each item costs, and we may change those amounts.

You lose your Coins when you delete your Account. Coins are not refunded or paid out in any situation.

10. Premium

Premium is a one-time purchase, not a subscription. Premium is sold to you by Apple or Google through the Store, under the Store’s terms. We do not process your payment and we do not see your card.

What Premium includes:

What Premium does not include:

The price is set in the Store. The Store shows you the price in your currency before you pay. It can differ between countries.

Premium stays with your Store account. You can restore Premium from the Premium screen, and the App also restores it when it starts. Deleting your Account does not remove it.

Refunds go through the Store first. Apple handles refund requests at https://reportaproblem.apple.com. Google handles them through Google Play, as explained at https://support.google.com/googleplay/answer/2479637. If the Store declines your request and the consumer law that applies to you gives you a remedy against us, write to info@liontude.com and we will handle it directly.

If you are a Consumer in the EU or UK, your statutory rights stay. Nothing in this section limits any right you have under your consumer law to withdraw from the purchase, or to a remedy if Premium is not as described. A right to withdraw from the purchase is exercised through the Store that sold it to you.

11. Ads

The free version shows ads. Ads come from Google AdMob. Full-screen ads appear between levels, never during a Duel. Premium removes them (section 10, “Premium”).

Some ads are optional. You can choose to watch a video ad to earn Coins. These optional videos are available with or without Premium.

Where the law requires your consent, the App asks for it. Ads are personalized only with your consent. The Privacy Policy explains what data ads use and how to change your choice.

12. Your permission to use the App

We give you a limited license to use the App. Liontude grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on phones you own or control, for your own non-commercial use, under these Terms and the Store’s usage rules.

This is a license, not a sale. You do not own the App or any Coins, Premium features or other content in it.

13. What belongs to us

The Service belongs to Liontude and its licensors. This includes the App, the website, the levels, our software, our designs and the Sort Duel name and logo. No other rights are granted, and all rights not expressly granted are reserved. Nothing in these Terms gives you a license to use our trademarks.

Feedback. If you send us feedback, suggestions or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without obligation or compensation to you. You are not required to send us feedback.

14. Apple and Google

These Terms are between you and Liontude, not Apple or Google. Liontude alone is responsible for the App and its content.

Apple and Google have no obligation to support the App. Liontude alone is responsible for maintenance and support (section 22, “Contact”).

Warranty questions are ours. If the App fails to conform to a warranty that applies to it, you may notify Apple, and Apple may refund the price you paid for Premium, if any. Apple has no other warranty obligation for the App.

Claims about the App are ours to handle, not Apple’s or Google’s. This includes product liability claims, claims that the App does not meet a legal or regulatory requirement, claims under consumer protection or privacy law, and claims that the App or your use of it infringes someone else’s intellectual property.

Store terms apply too. You must comply with the terms of the Store you got the App from when you use the App.

Apple and Google can enforce these Terms. Apple and its subsidiaries, and Google, are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you.

15. The Service is provided as is

We provide the Service “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be free of errors or interruptions, or that your progress or scores will never be lost.

Your statutory rights are not affected. If you are a Consumer, you keep every warranty and remedy that your law gives you and that cannot be excluded by contract. This section does not limit them.

16. Our liability

Liontude’s total liability is capped. To the extent the law allows, Liontude’s total liability to you for all claims about the Service is limited to the greater of the amount you paid for Premium and 50 US dollars.

We are not liable for indirect losses. To the extent the law allows, Liontude is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost Coins.

Some liability cannot be limited. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow to be limited or excluded.

If you are a Consumer in the EU or UK, this section applies only as far as your law allows. We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.

17. Your responsibility to us

If your misuse causes a claim against us, you cover it. To the extent the law allows, you agree to indemnify Liontude against claims, losses and reasonable legal costs that arise from your breach of section 5 (“Your alias”) or section 6 (“Playing fair”).

This does not apply to Consumers where the law does not allow it. If you are a Consumer in a country whose law does not allow this obligation, it does not apply to you.

18. Ending this agreement

You can stop at any time. To end this agreement, delete your Account from Settings and uninstall the App.

We can stop offering the Service. If we decide to stop offering the Service entirely, we will announce it on sortduel.com at least 30 days before online features end.

Some sections survive the end of this agreement. Sections 5 (“Your alias”, only the permission to show your Alias and your games, for as long as it lasts), 9 (“Coins”, the part on no money value), 13 (“What belongs to us”, including the feedback license), 14 (“Apple and Google”), 15 (“The Service is provided as is”), 16 (“Our liability”), 17 (“Your responsibility to us”), 19 (“Law and disputes”) and 21 (“General terms”) continue to apply after this agreement ends.

19. Law and disputes

If you are a Consumer outside the United States, your local law and courts stay available to you. Nothing in this section takes away the protection of the mandatory law of the country where you live, or your right to bring a claim in the courts there. EU and UK Consumers keep the protection of their consumer law.

For everyone else, Florida law applies. These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The state or federal courts located in Broward County, Florida, have exclusive jurisdiction.

Talk to us first. Before starting a claim, write to info@liontude.com and give us 60 days to try to resolve the dispute in good faith. This does not apply to urgent measures to protect rights, and it does not shorten any time limit for bringing a claim.

No jury. To the extent the law allows, you and Liontude each waive the right to a jury trial.

Costs. The party that substantially prevails in a claim is entitled to its reasonable legal costs, unless the consumer law that applies to you says otherwise.

20. Changes to these Terms

We will give notice before a material change. If we change these Terms in a way that affects your rights or obligations, we will post the new version on sortduel.com at least 30 days before it takes effect. Smaller corrections take effect when posted.

Each version has a number and a date. The version number and effective date are at the top of this page. When we replace these Terms, the earlier version stays readable on sortduel.com.

If you do not accept a change, stop using the Service. You can delete your Account as described in section 4 (“Your account”). Using the Service after a change takes effect means you accept it.

21. General terms

Assignment. We may transfer this agreement to a company that takes over the Service. You may not transfer it without our written consent.

Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Liontude about the Service.

Severability. If a court finds part of these Terms unenforceable, the rest stays in effect.

No waiver. If we do not enforce a part of these Terms, we have not given up the right to enforce it later.

Events outside our control. We are not responsible for a failure or delay caused by events outside our reasonable control, such as outages of our providers, natural disasters or government action.

Notices. We give notices on sortduel.com or in the App. The App does not have your email address, so we cannot write to you directly. You give notices to us at info@liontude.com.
